Explore New Progress in International IPR Cooperation

With the principle of serving China's diplomacy, economy, science and technology and foreign trade as well as IPR, China's IP international cooperation will be more active in promulgating international regulations and standards in the IP field, rather than merely accepting or following international routine.

Some basic work will be enforced, such as collecting, editing and studying IP international developments and IP information from the most developed countries and upgrading preparation plans and ability to deal with unexpected events.

Communication and coordination among various government departments will be enhanced, as will the connection with Chinese embassies abroad and cooperation with Chinese enterprises. IP work involving foreign countries will be more seriously tackled, and a mechanism to settle international IP disputes will be completed.

China will further enforce its connection with World Intellectual Property Organization (WIPO), the International Union for the Protection of New Varieties of Plants (UPOV) and the World Trade Organization (WTO), as well as other international organizations and actively engaged in promulgating and amending international IP rules and expanding China's influence in international IP cooperation.

Cooperation with developed and developing countries will be promoted, and China will further expand its international cooperation for creating a more favorable international environment.

China will enhance its cooperation and exchange with other countries in the trademark field, especially with those with whom it has close trade relations so as to promote trade and investment, and it take a greater role in various negotiations, amendments to the Trademark Law Treaty and other matters involving international trademark legal matters.

SIPO will investigate the needs of Chinese enterprises in international trademark protection, and try its best to protect the trademark interests of Chinese companies abroad.

In the field of copyright protection, China will be more active in international cooperation, such as regular meetings with American counterparts for film copyright protection, and achieving better understanding thro9ugh the film copyright protection mechanism so as to establish effective ways to enforce international cooperation in overall IPR protection. Cooperation and exchanges with WIPO, WTO, APEC and other international organizations in the copyright field will continue, and China will involve itself more in making new international copyright rules and attending relevant international conferences.

In addition, China will actively develop its cooperation with developing countries, especially those in Asia, to change the present unfavorable international copyright protection system for them. SIPO will continue work together with foreign copyright organizations to fight against international internet infringement activities, such as with the Motion Picture Association of America (MPA) and the International Federation of Phonogram and Videogram Producers (IFPI) in information sharing and technical services. Relevant international organizations will be invited to China to show their achievements in IPR protection and to exchange ideas.

In term of patent protection, SIPO will foster its cooperation and communications with other countries and organizations, such as the regular Sino-American Senior IP Dialogue, numerous symposia or training programs jointly held by SIPO and WIPO, Sino-American IP Symposium proposed by the US Patent and Trademark Office. China will host Asia-Pacific International Symposium on Gene Resources, Traditional Knowledge and Folk Arts, and send it people to study IP laws in developed countries.

China will foster international cooperation and communication in customs IPR protection. Under the mechanism of China-US Joint Commission on Commerce and Trade, Chinese Customs will start information and intelligence exchange in IP cases with their American counterpart.

In the 11th Five-Year Plan, China will closely watch the reform and development of the international IP system, study the rule and characteristics of domestic and international IPR disputes and relevant countermeasures, properly deal with cases involving foreign countries, establish and complete an international cooperation mechanism in fighting against IPR infringements and cross-country or border infringement crimes.
