| 一、“981”鉆井平臺(tái)作業(yè) | I. The operation of the HYSY 981 drilling rig |
| 2014年5月2日，中國(guó)企業(yè)所屬“981”鉆井平臺(tái)在中國(guó)西沙群島毗連區(qū)內(nèi)（作業(yè)位置圖見附件1）開展鉆探活動(dòng)，旨在勘探油氣資源。目前，第一階段工作已經(jīng)完成，第二階段工作已于5月27日開始。前后作業(yè)海域距離中國(guó)西沙群島中建島和西沙群島領(lǐng)海基線均17海里，距離越南大陸海岸約133至156海里。 | On 2 May 2014, a Chinese company's HYSY 981 drilling rig started its drilling operation inside the contiguous zone of China's Xisha Islands (see Annex 1/5 for the locations of operation) for the purpose of oil and gas exploration. With the first phase of the operation completed, the second phase began on 27 May. The two locations of operation are 17 nautical miles from both the Zhongjian Island of China's Xisha Islands and the baseline of the territorial waters of Xisha Islands, yet approximately 133 to 156 nautical miles away from the coast of the Vietnamese mainland. |
| 10年來，中國(guó)企業(yè)一直在有關(guān)海域進(jìn)行勘探活動(dòng)，包括地震勘探及井場(chǎng)調(diào)查作業(yè)等。此次“981”平臺(tái)鉆探作業(yè)是勘探進(jìn)程的例行延續(xù)，完全在中國(guó)主權(quán)和管轄權(quán)范圍內(nèi)。 | The Chinese company has been conducting explorations in the related waters for the past 10 years, including seismic operations and well site surveys. The drilling operation carried out by HYSY 981 this time is a continuation of the routine process of explorations, and falls well within China's sovereignty and jurisdiction. |
| 二、越南的挑釁 | II. Vietnam's provocation |
| 中方作業(yè)開始后，越南方面即出動(dòng)包括武裝船只在內(nèi)的大批船只，非法強(qiáng)力干擾中方作業(yè)，沖撞在現(xiàn)場(chǎng)執(zhí)行護(hù)航安全保衛(wèi)任務(wù)的中國(guó)政府公務(wù)船，還向該海域派出“蛙人”等水下特工，大量布放漁網(wǎng)、漂浮物等障礙物。截至6月7日17時(shí)，越方現(xiàn)場(chǎng)船只最多時(shí)達(dá)63艘，沖闖中方警戒區(qū)及沖撞中方公務(wù)船累計(jì)達(dá)1416艘次。 | Shortly after the Chinese operation started, Vietnam sent a large number of vessels, including armed vessels, to the site, illegally and forcefully disrupting the Chinese operation and ramming the Chinese government vessels on escort and security missions there. In the meantime, Vietnam also sent frogmen and other underwater agents to the area, and dropped large numbers of obstacles, including fishing nets and floating objects, in the waters. As of 5 pm on 7 June, there were as many as 63 Vietnamese vessels in the area at the peak, attempting to break through China's cordon and ramming the Chinese government ships for a total of 1,416 times. |
| 越方上述行為嚴(yán)重侵犯了中方的主權(quán)、主權(quán)權(quán)利和管轄權(quán)，嚴(yán)重危及中方人員和“981”鉆井平臺(tái)的安全，嚴(yán)重違反包括《聯(lián)合國(guó)憲章》、1982年《聯(lián)合國(guó)海洋法公約》、1988年《制止危及海上航行安全非法行為公約》和《制止危及大陸架固定平臺(tái)安全非法行為議定書》在內(nèi)的相關(guān)國(guó)際法，破壞了該海域的航行自由與安全，有損于地區(qū)和平穩(wěn)定。 | The above-mentioned actions of the Vietnamese side were serious infringements upon China's sovereignty, sovereign rights and jurisdiction, grave threats to the safety of Chinese personnel and the HYSY 981 drilling rig, and gross violations of the relevant international laws, including the Charter of the United Nations, the 1982 UN Convention on the Law of the Sea (UNCLOS) and 1988 Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation and the Protocol for the Suppression of Unlawful Acts against the Safety of Fixed Platforms Located on the Continental Shelf. Such actions also undermined the freedom and safety of navigation in these waters, and damaged peace and stability in the region. |
| 在海上對(duì)中方企業(yè)正常作業(yè)進(jìn)行非法強(qiáng)力干擾的同時(shí)，越方還縱容其國(guó)內(nèi)反華游行示威。5月中旬，數(shù)千越南不法分子對(duì)包括中國(guó)在內(nèi)的多國(guó)在越企業(yè)進(jìn)行打砸搶燒，殘酷殺害4名并打傷300多名中國(guó)在越公民，并造成重大財(cái)產(chǎn)損失。 | While illegally and forcefully disrupting the normal operation of the Chinese company on the sea, Vietnam also condoned anti-China demonstrations at home. In mid-May, thousands of lawless elements in Vietnam conducted beating, smashing, looting and arson against companies of China and several other countries. They brutally killed four Chinese nationals and injured over 300 others, and caused heavy property losses. |
| 三、中方的反應(yīng) | III. China's response |
| 中國(guó)西沙群島與越南大陸海岸之間存在海域劃界問題，雙方迄未在該海域進(jìn)行專屬經(jīng)濟(jì)區(qū)和大陸架劃界。雙方均有依據(jù)1982年《聯(lián)合國(guó)海洋法公約》主張專屬經(jīng)濟(jì)區(qū)和大陸架的權(quán)利。但無論以何原則劃界，該海域都不可能成為越南的專屬經(jīng)濟(jì)區(qū)和大陸架。 | The waters between China's Xisha Islands and the coast of the Vietnamese mainland are yet to be delimited. The two sides have not yet conducted delimitation of the Exclusive Economic Zone (EEZ) and continental shelf in these waters. Both sides are entitled to claim EEZ and continental shelf in accordance with the UNCLOS. However, these waters will never become Vietnam's EEZ and continental shelf no matter which principle is applied in the delimitation. |
| 對(duì)越方在海上的挑釁行動(dòng)，中方保持了高度克制，采取了必要的防范措施，派遣公務(wù)船到現(xiàn)場(chǎng)保障作業(yè)安全，有效地維護(hù)了海上生產(chǎn)作業(yè)秩序和航行安全。同時(shí)，5月2日以來，中方在各個(gè)層級(jí)與越方進(jìn)行了30多次溝通，要求其停止非法干擾活動(dòng)。令人遺憾的是，越方的非法干擾活動(dòng)仍在繼續(xù)。 | In the face of Vietnam's provocative actions on the sea, China exercised great restraint and took necessary preventive measures. Chinese government ships were dispatched to the site for the purpose of ensuring the safety of the operation, which effectively safeguarded the order of production and operation on the sea and the safety of navigation. In the meantime, since 2 May, China has conducted over 30 communications with Vietnam at various levels, requesting the Vietnamese side to stop its illegal disruption. Regrettably, however, the illegal disruption of the Vietnamese side is still continuing. |
