The chief executives of Samsung and Apple failed to reach a compromise over the high-stakes patents dispute between the two electronic makers after a phone discussion, Samsung attorney Kevin Johnson told a court on Monday.

Samsung's Kwon Oh Hyun talked with Apple's Tim Cook on the phone to explore settlement once again before trial, as required by the U.S. District Judge Lucy Koh in federal court in San Jose earlier.

A nine-person California jury will begin deliberating the landmark design patents battle between Apple and Samsung this week.

The two rivals dominate more than half of worldwide smartphone sales, and are engaged in a patents battle in multiple countries in a bid to occupy industry supremacy.

Apple accuses Samsung of copying the design and features of its iPad and iPhone and requests monetary damages as well as a sales ban of the involved Samsung products from the U.S. market.

Samsung also filed a toe-to-toe accusation saying Apple infringed several patents of the South Korean company, including its key wireless technology.

Before the trial, top executives from both Apple and Samsung had participated in unsuccessful court-ordered mediation talks. After that, Koh asked them to see whether they can settle the dispute before the case goes to the jury.

The lawsuit is risky to the both companies, Koh said last week.
